본 강좌에서는 가족법에 대한 법학적 이해를 바탕으로 친족과 상속에 관한 민법의 법률이론 및 중요 사례에 대한 분석과 쟁점을 검토함. 일상생활에서 접할 수 있는 친족 및 상속과 관련된 법률문제를 알아보고 법률관계의 이해 및 법리적 분석능력을 함양함. 친권과 후견, 친생자의 지위, 혼인과 이혼, 입양과 파양, 부모와 자, 상속과 유언을 둘러싼 법률관계를 체계적으로 고찰함. 친족 및 상속과 관련된 중요한 사례를 분석하고 대법원의 판례와 외국의 입법례 및 학설에 대한 법리적 검토를 수행함.
교과목해설(영문)
In this lecture, based on the legal understanding of family law, we analyze the legal theory and important cases of the civil law concerning the family and inheritance. Students will learn legal issues related to family and inheritance that can be encountered in everyday life, and gain understanding of legal relationship and ability of legal analysis. We systematically examine the legal relationship between chancellery and guardianship, status of parents, marriage and divorce, adoption and adoption, parents and children, inheritance and testament. Analyze important cases related to kinship and inheritance, and conduct judicial review of Supreme Court precedents and foreign legislation and theories.
